KYIV. May 9 (Interfax-Ukraine) – The Supreme Court of Ukraine upheld the position of the prosecutor in the case of the return of communal property to the territorial community, which was removed from its property on the basis of forged documents, the press service of Kyiv City Prosecutor’s Office said.
“Thus, by a ruling of the Supreme Court, the decision of the courts that sustained the claim of Solomiansky district prosecutor’s office of Kyiv city and the non-residential premises worth more than UAH 2.5 million claimed in favor of the territorial community of the capital was upheld. It has been established that the ownership of communal premises with an area of more than 190 square meter in a house on Peremohy Avenue in Kyiv (near the Shuliavska metro station), which is an architectural monument of local importance, passed to an individual on the basis of a non-existent investment agreement and subsequently alienated to another citizen,” the office said.
Sustaining the claim, the judges agreed with the arguments of the prosecutor that since the disputed non-residential premises were removed from the ownership of the city’s territorial community without the approval of Kyiv City Council, it is subject to reclaim.
At present, Kyiv City Prosecutor’s Office is taking measures to actually enforce the judgment.
