KYIV. Nov 1 (Interfax-Ukraine) – The Constitutional Court of Ukraine (CC) has recognized the law on the abolition of parliamentary immunity in the country as consistent with the Constitution, the Communications and Legal Monitoring Department of the CCU reports.
"On Tuesday, November 1, at the plenary session, the Grand Chamber of the Constitutional Court of Ukraine adopted a decision on the case of constitutional control of amendments to the Constitution that have entered into force according to the constitutional motion of 50 MPs regarding compliance with the Constitution of Ukraine (constitutionality) of the law ‘On amendments to Article 80 of the Constitution of Ukraine (on the inviolability of members of parliament of Ukraine).’ Having come to the conclusion that the constitutional procedure of consideration, adoption and entry into force of the Law was not violated, the Constitutional Court of Ukraine recognized the contested Law as corresponding to the Constitution of Ukraine," the message reads.

As reported, 50 deputies, mainly from the now banned Opposition Platform – For Life party, submitted to the Constitutional Court a submission on appealing the law on the abolition of parliamentary immunity adopted by the Verkhovna Rada (Bill No. 2237), which entered into force on January 1, 2020.
According to the adopted amendments, a request for permission to detain, a measure of restraint (house arrest in custody), and other investigative search actions must be coordinated with the Prosecutor General.
Investigators of the NABU and the main office of the SBI have the right to conduct a pre-trial investigation of criminal proceedings opened against deputies. It is prohibited to entrust the pretrial investigation of a criminal offence committed by a member of parliament of Ukraine to other pretrial investigation bodies, except for the National Anti-Corruption Bureau of Ukraine (NABU) and the main office of the State Bureau of Investigations (SBI) in accordance with their jurisdiction.
