Economic court of Kyiv opens bankruptcy case for Kuznya on Rybalsky plant

KYIV. Dec 28 (Interfax-Ukraine) – The Economic Court of Kyiv has opened a bankruptcy case against PJSC Kuznya on Rybalsky (Kyiv) at the suit of Proktoremo Investments Limited (PIL, Cyprus) on the presence of debt in the amount of UAH 83.3 million upon purchase of Land Development LTD Plus LLC.

According to the court materials at the disposal of Interfax-Ukraine, the court adopted the decision to open a bankruptcy case on December 19, 2022.

According to the Claimant (PIL), Kuznya on Rybalsky Plant has a debt in the total amount of UAH 83.2 million, including UAH 83.215 million is the principal debt. Such debt arose during the acquisition 70% share of Land Development LTD Plus LLC from PIL. At the same time, the plant, in a letter dated November 29, 2022, said that it recognizes the debt, but does not have the funds to pay it off.

The court, by its ruling, recognized the presence of a debt from the plant in the amount of UAH 83.3 million, imposed a moratorium on satisfying the claims of creditors, introduced a procedure for disposing of the debtor’s property, appointed the arbitration manager of the enterprise Serhiy Boyarchukov and ordered him to provide information on the results of consideration of creditors’ claims by February 8, 2023 . The court also set a deadline until February 20, 2023 for an inventory of the debtor’s property.

A preliminary court hearing is scheduled for February 27, 2023.
