AMCU fines five companies UAH 4 mln for bid rigging for sale of Kyivska poultry farm

KYIV. Dec 15 (Interfax-Ukraine) – The Antimonopoly Committee of Ukraine (AMCU) has fined five companies UAH 3.98 million for collusion during the bidding for the sale of property complexes of Kyivska poultry farm in Kyiv and Kyiv region in 2020.

According to the website of the state regulator, a fine was imposed on Carpathian (Karpatska) Oil Company LLC, AMC Eurotrans-Invest LLC, Extrar LLC, FC Fingarant LLC and Aldaris-Group LLC participating in the auction.

During the investigation, the antimonopoly committee established facts proving the coordination of companies in preparing and participating in the auction, active communication between them, including the exchange of information about the auction.

"The specified combination of these and other circumstances indicates that the participants in anti-competitive trading have committed concerted actions to eliminate competition among themselves. Such actions are a violation of the law on protection of economic competition, therefore, Karpatska Oil Company LLC, Eurotrans-Invest, Extrar LLC, Fingarant FC LLC and Aldaris-Group LLC were fined," the committee said.

As reported, in October 2020, Eurotrans-Invest won the auction for the sale of Kyivska poultry farm arrested from Avangard agricultural holding for UAH 690 million, and the right to buy its property complex in Kyiv region for UAH 300 million was won by FC Fingarant.

A poultry farm with an area of 126,579 sq m, located in Brovarsky Avenue in Kyiv, and a property complex with a total area of 5,774 sq m located in the village of Pukhivka (Brovary district, Kyiv region), were auctioned.

As a result, the auction winning companies did not pay for the purchased lots, and the auction was declared invalid. The participants, who were determined as winners and did not pay, lost their guarantee fees in the total amount of UAH 13.1 million.
