AMCU fines participants in conspiracy at auction for sale of Ukrspyrt property UAH 14.3 mln

KYIV. Sept 5 (Interfax-Ukraine) – The Antimonopoly Committee of Ukraine (AMCU) found Ukrspetspostachannia LLC, Finance-Service Plus LLC and Glermont Trade LLC guilty of anti-competitive actions distorting the results of the auction for the privatization of distilleries and fined them UAH 14.39 million.

According to the press service of the committee, the matter concerns the auction for the sale of certain property of the Zalozetsky place of production and storage of alcohol by Ukrspyrt state enterprise, which was held by the regional branch of the State Property Fund of Ukraine in Ivano-Frankivsk, Chernivtsi and Ternopil regions. The amount of the contract concluded because of the auction amounted to UAH 96.012 million (including VAT).

“In the course of the investigation of the case, the committee discovered circumstances that, in their totality, testified to the commission by the specified economic entities of concerted actions, the purpose of which was to eliminate competition between them during the auction. We are talking, in particular, about such evidence as the conduct of joint economic activities by the defendants, the presence of communication between them, the exchange of information, etc.,” the AMCU explained.

For the violation provided for in Clause 4 of Part 2 of Article 6 and Clause 1 of Article 50 of the law on the protection of economic competition (anti-competitive concerted actions concerning the distortion of the results of the auction), as well as for collusion at the auction for the sale of state property, the defendants were fined UAH 14,390,798.
