Ukraine introduces preliminary 31.37% duty on import of glass containers from Belarus

KYIV. Nov 4 (Interfax-Ukraine) – On November 2, the Interdepartmental Commission on International Trade of Ukraine (ICIT) decided to apply a preliminary anti-dumping duty of 31.37% on imports of glass containers originating from Belarus to Ukraine, Ilyashev & Partners law firm said on Friday.

"The application of such measures is the result of a timely response by the government of Ukraine to manifestations of unfair competition of Belarusian manufacturers in the glass container market in Ukraine and will allow national manufacturers to quickly resume work to eliminate the consequences of dumping imports of goods," partner of the firm Olena Omelchenko is quoted in the press release.

Ilyashev & Partners said that they represented the interests of the Association of Glass Producers Glass of Ukraine, as well as its members.

According to the announcement, the duty will be levied on the following goods: glass containers (canning jars, bottles) for foodstuffs and drinks with a capacity of 0.15 liters or more, but less than 2.5 liters, which are classified according to Ukrainian Classification of Goods for Foreign Economic Activity codes 7010 90 41 00, 7010 90 43 00, 7010 90 45 00; jars made of colored glass with a nominal capacity of more than 0.33 liters, but less than 1 liter, which are classified according to foreign activity code 7010 90 53 00.

This decision is the first decision of the Commission on the application of restrictive measures on the import of goods into Ukraine after February 24, 2022, the law firm said. The firm said that the application of preliminary anti-dumping measures is an extremely rare intermediate result in the practice of conducting anti-dumping investigations in Ukraine. The last time such measures were applied by the ICIT was in 2020.

The preliminary anti-dumping duty is applied for a period of four months and will be charged from the date of publication of the decision of the ICIT in the Uriadovy Kurier newspaper.

The decision to violate and conduct an anti-dumping investigation based on the results of consideration of the complaint of Glass of Ukraine, prepared by Ilyashev and Partners, was adopted by the ICIT on December 22, 2021.

The Association of Glass Producers Glass of Ukraine is a public organization that unites Ukrainian manufacturers of glass containers, sheet glass, glassware, art glass, as well as suppliers of equipment, materials and services for the glass industry. It was founded in 1997. Members of the Association produce more than 80% of glass products in the country.
