Rada adopts law on writing off loans for property damaged or destroyed by war

KYIV. Dec 2 (Interfax-Ukraine) – Draft law No. 7441-1 on the suspension of servicing and writing off loans for housing and cars that were damaged or destroyed during the war was supported by the Verkhovna Rada with 265 votes on Thursday, Yaroslav Zhelezniak, a member of the Holos faction, said.

According to him, the law applies to property that, due to the war, ended up in the temporarily occupied territory or in the territory of active hostilities or damaged/destroyed as a result of hostilities.

The MPs noted that borrowers whose property or cars were destroyed as a result of the war are entitled to writing off their debts.

Zhelezniak clarified that restrictions on the area of real estate were removed by the second reading. However, it must be the only place of residence of the borrower’s family without overdue debts under the agreement as of February 23, 2022, and the purpose of obtaining a loan under the agreement is the acquisition, reconstruction or construction of real estate.

With regard to car loans, debt cancellation is possible in the event of the destruction of the car, if it is the only car in the borrower’s family and as of February 23, 2022, the debt under such an agreement was not overdue for more than 7 days.

"The lender in this case is entitled to compensation … for property destroyed as a result of the armed aggression of the Russian Federation. The amount of compensation cannot exceed the principal amount of the loan. Losses of the lender, for example, unearned interest, are lost profits and can be reimbursed … at the expense of the aggressor country," Zhelezniak wrote on Telegram.

The MP stressed that the deadline for submitting applications is the period of martial law in Ukraine and three months after the day of its termination, and in each case, borrowers must provide supporting documents to the lender.
