KYIV. Sept 4 (Interfax-Ukraine) – Public statements by the National Anti-Corruption Bureau (NABU) and the Specialized Anti-Corruption Prosecutor’s Office (SAPO) do not affect the consideration of cases in the High Anti-Corruption Court (HACC), however, it is dangerous to publish materials of undercover investigative actions before they are considered in court, HACC Head Vira Mykhailenko has said.
In an interview with Interfax-Ukraine, the court’s head said she did not know of cases of non-procedural appeals by prosecutors or detectives to judges in specific cases. “And this really confirms the delimitation of the functions of detectives, prosecutors and the court,” Mykhailenko said.
She drew attention to the fact that the public statements of NABU and SAPO do not affect the future proceedings in court.
“We understand and share the desire of the public to know the cases that NABU detectives are investigating under the procedural leadership of the SAPO, as well as the openness of issues of significant public interest,” the court’s head said.
However, Mykhailenko said “the disclosure of pretrial investigation materials, in particular, the results of covert investigative (detective) actions until they become the subject of consideration in court, is like moving on thin ice: it is very dangerous both in the context of the secrecy of the pretrial investigation, and in terms of the use of relevant information by interested parties.
