Supreme Court refuses to open cassation appeal for Ukrnaftoburinnia to cancel special permit for Sakhalinske field

KYIV. Dec 13 (Interfax-Ukraine) – The Supreme Court of Ukraine refused PrJSC Ukrnaftoburinnia to open cassation proceedings in the case of revoking the company’s special permit for Sakhalinske gas condensate field.

The court made the corresponding decision, the text of which is available to the Interfax-Ukraine agency, on December 12, 2023.

The Supreme Court stated that the decision of the court of first instance is not in the list of rulings that can be appealed in the manner established by Part 2 of Article 328 of the Code of Administrative Proceedings of Ukraine.

“Under such a legal settlement and the circumstances of the case, there are no grounds for opening cassation proceedings,” the court noted.

In addition, the Supreme Court refused JKX Ukraine B.V. and the Asset Recovery and Management Agency (ARMA), in opening cassation proceedings against the Sixth Administrative Court of Appeal. The court justified this by the fact that at all stages of the consideration of the case they did not declare a violation of their rights by the disputing parties, therefore they are not entitled to challenge this court decision.

As reported, on November 28, 2023, the Sixth Administrative Court of Appeal canceled the order of the State Service of Geology and Subsoil and canceled special permit No. 6349 dated July 10, 2019, in accordance with which Ukrnaftoburinnia carried out production at the field. The company stopped operation of the field on December 1.

The State Geological Service, in pursuance of the decision of the District Administrative Court of Kyiv, issued license No. 5139 to the company in February 2010, which was canceled on July 10, 2019. At the same time, the company received new special permit No. 6349 in connection with the expansion of the development boundaries of Sakhalinske field.
