Ukrainian MPs propose to introduce new sanction – compulsory sale of assets

KYIV. Dec 27 (Interfax-Ukraine) – Ukrainian parliamentarians propose to introduce a new sanction in the legislation of Ukraine – compulsory sale of assets.

Respective bill No. 8311 on amendments to some laws on improving the sanctions policy and increasing the efficiency of managing state, municipal property and seized assets was registered in the Verkhovna Rada on Tuesday, according to the website of the parliament.

The authors of the bill, in particular, propose to provide for compulsory sale of assets in the law on sanctions, which will allow immediately after the decision of the court to sell sanctioned assets.

According to the explanatory note, the introduction of this type of sanction will optimize the sanctions policy and allow the Cabinet of Ministers of Ukraine, represented by the Justice Ministry, to determine the appropriate type of sanction depending on the characteristics of the sanctioned property. The Justice Ministry will immediately determine the type of sanction in the claim, the decision on the application of which will be made by the High Anti-Corruption Court (HACC) in the future. After the adoption of the relevant decision of the HACC, the assets for which the sanction of compulsory sale has been applied will be transferred to Asset Recovery and Management Agency (ARMA). The sale will take place in the same format as the sale of other assets transferred to ARMA, only on a mandatory basis.

The authors of the bill include MPs David Arakhamia, Dmytro Natalukha, Andriy Motovylovets, Roksolana Pidlasa, Halyna Tretiakova (Servant of the People faction).
