UNGA to consider need to create intl compensation mechanism for losses caused by Russia’s aggression in Ukraine

KYIV. Oct 28 (Interfax-Ukraine) – The UN General Assembly at its scheduled meeting on November 14 will consider the need to create an international compensation mechanism for losses in Ukraine caused by the aggression of the Russian Federation, the press service of the Ministry of Justice reported.

"Support is expected with the adoption of the UN General Assembly resolution, the meeting is scheduled for November 14. This resolution will provide for the recognition of the need to create, in cooperation with the Government of Ukraine, an international compensation mechanism for damage to losses and recommendations will be given to the participating countries on the creation of an International Register of Losses," the press service quoted as saying Deputy Minister of Justice Iryna Mudra speaking at the national telethon.

According to her, after receiving this UN resolution, the work of the Ministry of Justice will continue in three directions, in particular, the creation of an international register of losses, negotiations with countries that will be ready to conclude an international agreement on the creation of a compensation mechanism, joint work on making appropriate changes to the national legislation of countries participating in the signing of an international agreement.

It is also noted that in the third direction, the Ministry of Justice has already started with Canada, the USA, the UK and the EU countries.

"The compensation mechanism will provide for the creation of a Commission to consider applications for compensation for damage caused by the aggression of the Russian Federation and an effective mechanism for implementing the decisions taken by the Commission. Compensation will be made at the expense of a Compensation Fund financed by Russian assets confiscated and blocked located on the territory of the states-parties to such an international agreement. These are assets of the Russian state, assets of state-owned Russian companies and oligarchs close to the path. First of all, we expect that the fund will be filled at the expense of Russia’s sovereign assets – these are gold-currency reserves of the Central Bank of Russia and assets of state–owned companies," Mudra explained.

The press service of the ministry notes that in May, by decree of the President of Ukraine, a working group was created that is engaged in the development and implementation of an international legal mechanism for compensation for damage caused by the aggression of the Russian Federation.

At the same time, the creation of a compensation mechanism was supported by the Committee of Ministers of the Council of Europe. Also, the PACE resolution of October 13 supported the need to create a compensation mechanism and a register of damage.

In addition, the proposal to organize a Special International Tribunal for aggression against Ukraine was noted.
